Something that Disney did not take kindly to.<\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\"><div class=\"wp-block-embed__wrapper\">\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\"><p lang=\"en\" dir=\"ltr\">Projects that have been announced after the early version of Mickey Mouse entered the public domain:<br><br>\u2022 MICKEY&#39;S MOUSE TRAP (horror film)<br>\u2022 Untitled film from Steven LaMorte (horror film)<br>\u2022 Infestation 88 (horror game) <a href=\"https:\/\/t.co\/3y6bbOMF9g\">pic.twitter.com\/3y6bbOMF9g<\/a><\/p>&mdash; Pop Crave (@PopCrave) <a href=\"https:\/\/twitter.com\/PopCrave\/status\/1742246911565013012?ref_src=twsrc%5Etfw\">January 2, 2024<\/a><\/blockquote><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script>\n<\/div><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\">An intellectual property law that is difficult to interpret<\/h2>\n\n\n\n<p>The end of intellectual property has been marked by <em>a confusing series of moderation decisions by Disney,<\/em> where no one knows who is right and who is not.<\/p>\n\n\n\n<p>In the early days of January, it seems that <strong>Disney was still filing lawsuits to block the video on YouTube<\/strong> in some international markets. Mashable reported that a remix had been demonetized along with the restriction in those markets.<\/p>\n\n\n\n<p>And illustrator Jef Caine posted on TeePublic a withdrawal notice he had received for a stylized Mickey Mouse t-shirt with the slogan &#8220;No Man Owns My Destiny&#8221;.<\/p>\n\n\n\n<p>It is still unclear whether each of these demands was a reasoned decision, an excess of caution, or a simple coincidence. But the fact that they appear is not surprising.<\/p>\n\n\n\n<p><strong>The strong enforcement of copyright has shaped the boundaries and culture of the Internet<\/strong>. It is ill-prepared for a world where a large number of people are pushing the limits of a nuanced legal framework, and as pop culture becomes public property, the situation can become more complex.<\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-4-3 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n<iframe loading=\"lazy\" title=\"Steamboat Willie\" width=\"840\" height=\"630\" src=\"https:\/\/www.youtube.com\/embed\/hmzO--ox7X0?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" allowfullscreen><\/iframe>\n<\/div><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\">What can we clearly take from all this mess<\/h2>\n\n\n\n<p>In a research work carried out by <strong><a href=\"https:\/\/www.theverge.com\/2024\/1\/5\/24026433\/mickey-mouse-steamboat-willie-youtube-teepublic-takedowns-public-domain\" target=\"_blank\" rel=\"noopener nofollow\" title=\"\">The Verge<\/a><\/strong>, they explain that there are some possible obvious explanations for the takedowns, since the previous examples touch on gray areas where restrictions could still apply.<\/p>\n\n\n\n<p><strong>The first is that the copyright situation of Steamboat Willie remains potentially more complicated outside the US<\/strong>, especially in Europe, which is where YouTube seems to be restricting access.<\/p>\n\n\n\n<p><strong>The second is that Disney still holds a trademark on Mickey<\/strong>, so &#8211; as explained by Duke Law School professor Jennifer Jenkins with a handy mouse-shaped diagram &#8211; they can argue that certain products may mislead people into believing that they have been created or endorsed by Disney.<\/p>\n\n\n\n<figure class=\"wp-block-image size-full is-resized\"><img decoding=\"async\" src=\"https:\/\/articles-img.sftcdn.net\/sft\/articles\/auto-mapping-folder\/sites\/2\/2024\/01\/Mickey_Mouse_Trademark_and_Copyright_Do.jpg\" alt=\"\" class=\"wp-image-323590\" style=\"aspect-ratio:1.0175;width:630px;height:auto\" \/><figcaption class=\"wp-element-caption\">Jennifer Jenkins \/ Sean Dudley<\/figcaption><\/figure>\n\n\n\n<p><strong>The third one is that Disney still holds the copyright for later iterations of the character<\/strong>, who appeared in Steamboat Willie without the features that are now standard, such as the white gloves or (being a black and white film) the bright red shorts.<\/p>\n\n\n\n<p>Both features were included in the original design of Caine&#8217;s shirt and notably not in a reworked version that is still available.<\/p>\n\n\n\n<p><strong>But ambiguity doesn&#8217;t entirely favor Disney.<\/strong> Jenkins points out that &#8220;not all features of later iterations of Mickey are susceptible to individual copyright protection,&#8221; including &#8220;merely trivial&#8221; updates or those that use obvious stock elements.<\/p>\n\n\n\n<p>Even Techdirt points out that the European policy of &#8220;shorter term rule&#8221; for<strong> international copyright can push Mickey into the public domain there.<\/strong><\/p>\n\n\n\n<p>In addition to the public domain freedoms, <strong>the US fair use law allows for parodies and commentary on a copyrighted work<\/strong>, so some of these explicitly subversive takes on Mickey could have been legal even before this week.<\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\"><div class=\"wp-block-embed__wrapper\">\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\"><p lang=\"es\" dir=\"ltr\">El corto STEAMBOAT WILLIE (1928) de UB Iwerks ya es de dominio p\u00fablico [la versi\u00f3n sonora de Disney reci\u00e9n estar\u00e1 libre de derechos dentro de un a\u00f1o].<br><br>Lo que significa que el cortometraje original de Mickey Mouse ya puede compartirse por aqu\u00ed y que&#8230;<a href=\"https:\/\/t.co\/1QCZckwUXM\">pic.twitter.com\/1QCZckwUXM<\/a><\/p>&mdash; Carla \u2741 (@shannonlada) <a href=\"https:\/\/twitter.com\/shannonlada\/status\/1741944558097662370?ref_src=twsrc%5Etfw\">January 1, 2024<\/a><\/blockquote><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script>\n<\/div><\/figure>\n\n\n\n<p>It is difficult to know for sure, because fair use is not a simple flowchart of hard and fast rules, but rather requires a case-by-case analysis weighing several factors. Relying on the public domain is a much safer bet.<\/p>\n\n\n\n<p>Content moderation at a large scale, in an Internet dominated by a handful of huge and powerful platforms, hides all this complexity. Although in favor of YouTube and other platforms, you can find a lot of Steamboat Willie content right now.<\/p>\n\n\n\n<p><strong>Internet moderation is an impersonal, multi-level, and often automated process<\/strong>, which often does not provide recipients with much information about what they have done wrong. Given the enormous volume of content, false positives are common.
