Anthropic is facing a proposed class-action lawsuit over its Claude Max subscriptions, filed in the U.S. District Court for the Northern District of California. The complaint turns on a simple question: did Anthropic’s top-tier Claude Max plans actually give subscribers the level of usage the company advertised?
The suit zeroes in on the $100 Max 5x plan and the $200 Max 20x plan. Anthropic markets them as offering five times and 20 times the usage of Claude Pro. Plaintiff Karl Kahn says that wasn’t his experience, especially during long coding sessions, where the limits showed up much faster than the marketing suggested.
In the filing, Kahn says Max 5x worked out to something closer to 3.5x usage, while Max 20x delivered only about six to eight times as much. He also says the weekly caps were surprisingly easy to burn through. In one five-hour session, he claims, 15% of his total allowance was gone.
Kahn’s argument is that this crosses into bait-and-switch territory. At the center of the case is his claim that Anthropic doesn’t clearly spell out how premium usage is measured. The complaint says that leaves subscribers unable to predict, compare, or even track what they’re really getting from a flat-rate plan. The proposed class wants reimbursement for everyone who subscribed to Max 5x or Max 20x starting in April 2025, along with a court ruling that Anthropic’s marketing was fraudulent.

The case is now making its way through federal court in California, just as consumer lawyers and regulators are paying closer attention to fuzzy usage caps on pricey AI subscriptions. It also lands as Connecticut gets ready to enforce a new law on October 1 that will require companies to disclose usage limits before people sign up. That could help set a firmer standard for what claims like “5x” and “20x” are actually supposed to mean.
