Terms and Conditions for “SOFTONIC – Ashampoo Burning Studio 18 licenses” promotion

(hereinafter the “Promotion”)

1. This Promotion is run by Softonic International, S.L., whose registered office is at MediaTic Building – Roc Boronat, 117, 6th Floor – 08018 Barcelona (SPAIN) (“Promoter”).

2. The Promotion is open internationally to persons aged 18 or over, excluding employees of the Promoter and its affiliated companies and their immediate families, as well as any other persons and companies professionally associated with this Promotion.

No purchase is necessary to enter the Promotion. In order to be eligible to participate in this Promotion, it is simply necessary to be a follower of the Ashampoo´s Facebook page (https://www.facebook.com/Ashampoo/), leave a comment telling us what is your most important internet security feature and share the picture.

By taking part in this Promotion all participants will be deemed to have accepted and be bound by these terms and conditions.

3. The Promotion commences at 11:00 am Eastern Daylight Time (EDT) on Tuesday 20th December 2016 and closes at 23:59 pm EDT on Wednesday 28th October 2016.

4. Prizes: The 50 winners will receive an Ashampoo Burning Studio 18 license, worth $59.99 each

The Prizes are non-transferable and there is no cash alternative. The Promoter reserves the right to offer an alternative prize of equal or greater value should the advertised prize become unavailable for any reason.

5. There will be one (50) Prizes Winners, who will be selected by the Easypromos App raffle system.

6. Announcement of the Prize winners: all Winners will be notified via e-mail after Thursday 29th December 2016

7. Delivery of the Prizes: The Promoter shall contact each Winner via email. Winners will be required to provide his or her complete name and address to the Promoter in order to be eligible to receive the Prize. Each of the winners must provide the above details within the period of three (3) weeks from the date when they were notified. If a person drawn as a winner of a prize does not confirm acceptance of the Prize and provide the above-mentioned information by the end of that period of three (3) weeks, then the Promoter reserves the right to draw an alternate winner from the valid entries received at the time that the Promotion ended.

The prizes will be sent in the form of an activation code via email.

8. Your personal information will be used by the Promoter to conduct the Promotion, and in accordance with Softonic’s Privacy Policy, found at http://www.softonic.com/legal.

In addition to the Privacy Policy, if you are a winner of a prize, the Promoter may use your information for marketing or promotional purposes, including using your name and your Facebook profile picture to announce the winners online including but not limited to Softonic’s web pages, OnSoftware blog and Softonic’s profile-pages on Facebook, YouTube, Twitter, Google+, Pinterest and Instagram.

Further, if you are a winner of a prize, the Supplier may use your information collected during the Promotion in order to arrange for the delivery of the prizes and to announce the winner online on its webpage and social media. The Supplier will use your personal information in accordance with its Privacy Policy found at http://www.anchorfree.com/privacy.php.

By entering this Promotion, you agree to the processing by the Promoter and the Supplier of your personal information for the purposes and in the manner set out above and in their respective Privacy Policies.

9. By entering the Promotion you agree that the Promoter may include your name and contact information in a database and use it for future promotional campaigns and communications. In accordance with the Promoter´s Privacy Policy, you will have the right to access, modify or cancel such treatment of your personal details.  Please see the Promoter´s Privacy Policy for further details: http://www.softonic.com/legal.

10. Other than death or personal injury arising from the acts or omissions of the Promoter or its employees, the Promoter will accept no responsibility for any loss, damage, injury or disappointment suffered by any participant from entering this Promotion or by a winner´s acceptance or enjoyment of a prize.

11. This Promotion is in no way sponsored, endorsed or administered by, or associated with Facebook. By entering you confirm that you understand that you are providing your information to the Promoter and the Supplier and not Facebook. By entering the Promotion all participants agree to release Facebook completely of any liability.

12. The Promoter reserves the right to cancel, modify or supersede the Promotion (including altering the prizes) at its sole discretion, if it is not capable of being conducted as specified. The Promoter reserves the right to substitute a prize in the event that circumstances beyond its control make this necessary.

13. The decision of the Promoter is final and binding in all matters relating to this Promotion.

14. These terms and conditions and all matters arising from or in connection with them are governed by the laws of Spain without regard to conflict of law rules and the courts of Barcelona will have exclusive jurisdiction.

The contest is limited and addressed exclusively to people over 18, worldwide.

2. – DURATION

From 16/12/2016 to 22/12/2016 23:59, inclusive. The winner will be notified on 23/12/2016 by message via Facebook .

4. – PROTECTION OF PERSONAL DATA

Data from participants will be included in a Softonic’s automatic file. This file has the sole purpose of maintaining a record of all participants in the draw and deliver the prize. To access, rectify or delete the data provided, participants can send an email to legal@softonic.com indicating in the subject “Contest Data Rights”.

5. – Selecting a Winner

One winner will be selected at random from eligible entries on 23/12/2016.

1 winner will be chosen. Failure to establish a winner by inability to contact him or her would imply the contest to be declared void.

6. – PRIZE

The prize is a $ 50 voucher that can be redeemed on Softonic Deals. Softonic Deals is a third party online shop thus Softonic disclaim all liability from the product or services obtained by redeeming the voucher.

8. – VARIOUS

Softonic International, S.A. as organizer, reserves the right to modify at any time the terms of this contest, including the date hereof, and may even cancel it before the close of the draw, whenever there was cause, and will make its best efforts to notify well in advance of the new rules, conditions, or if the final cancellation by sufficient publicity means in social networking. If the draw date changes, participants had already complied with the conditions of participation before the amendment thereto continue flaunting status of participants and therefore every right to participate in it. Participation in this contest implies full acceptance of these rules. Given the possible doubts in the interpretation of the same, organizer criteria always prevail. Participants in this contest expressly waive the jurisdiction that may apply, submitting expressly Courts of Barcelona Capital, for any dispute arising out of this terms. Participants of this draw specifically authorize the organizer to use for advertising and marketing purposes their name and likeness, for free, as well as the publication of the winner’s name on the website and / or social networks.

The prize will not be exchanged for its cash value. Softonic, to the fullest extend by Law, has no liability in respect of any incident, accident, injury or any other condition that may occur to each winner in the enjoyment of the prize. Softonic has no responsibility for any loss, damage, delay or any other circumstances attributable to third parties that may affect the characteristics of the prize. Softonic reserves the right to refuse participation of participants who are in one of the following circumstances:

• In any case where Softonic can interpret that the participant is making fraudulent use of the draw.
• Employees of Softonic
• Employees of companies, advertising or promotional agencies who are involved in the draw.
• Immediate family members and spouses of the persons included in the above.
• Minors, which require the authorization of their legal representatives.
