The relationship between big companies and labor rights has always been complicated. Amazon has once again made it clear that it claims that the National Labor Relations Board (NLRB) is unconstitutional.
This is not an isolated movement. Space X, a company founded by Elon Musk, filed a lawsuit last January following a similar argument to Amazon’s. This was followed by Trader Joe’s a few weeks later.
One of the purposes of the Board is to file complaints against employers or unions that, in its opinion, violate federally protected labor rights. This Board consists of a prosecution that is responsible for carrying out these processes.
In this case, the Board’s prosecutor accused Amazon of illegally retaliating against workers at a Staten Island warehouse, which was unionized two years ago. This has prompted a response from Amazon, who argues that they have not violated the law. Furthermore, in their complaint, they accuse the Board of violating the Fifth and Seventh Amendments of the United States Constitution.
This is Amazon’s latest attempt to block union organization within its centers. If their threats ultimately succeed, American workers could lose much of the labor protections, gained almost a century ago.
