Newly unsealed filings in the copyright lawsuit led by The New York Times against Microsoft and OpenAI show that people inside both companies did discuss the risk that using news content to build chatbots could hurt publishers.
The filings quote Microsoft researcher Brent Hecht calling mass scraping for AI training “an astonishing theft of unprecedented proportions”, possibly “the largest theft of labor in human history,” and saying it made fair use “a complete mockery.” They also say OpenAI executive Nick Turley warned of an “existential threat” to publishers, and that a Microsoft document described a chatbot “doom loop” in which traffic dries up for the same news sites supplying the source material.
Publishers say that loop is already underway. According to the filings, Microsoft recorded click-through-rate drops of 83% to 93% for some plaintiffs and 51% to 94% for others, putting subscriptions, ad impressions, and revenue at risk. Microsoft and OpenAI still argue that training and outputs can qualify as fair use. Publishers disagree, especially when millions of articles are used without permission. Separately, the U.S. Department of Justice has said that some copyright training can be lawful.
