Sony has filed a lawsuit against Tencent, accusing the Chinese tech giant of copying elements from its acclaimed game Horizon Zero Dawn in its new project, Light of Motiram. The lawsuit has labeled Tencent’s title as a “servile clone,” which has prompted a swift response from the defendant company.
Tencent, more expensive than its back
In its defense, Tencent argues that Sony has sued the wrong parties and points out that the lawsuit is deficient. The Asian giant claims that Sony has not demonstrated that the court has personal jurisdiction over Tencent Holdings, stating that the alleged acts of infringement did not occur as claimed and that most of the intellectual property elements are not adequately presented in the lawsuit.
Tencent also rejects Sony’s trademark infringement claims, stating that fame does not automatically grant trademark rights. In its 21-page response, Tencent argues that Sony has not presented specific facts to support its claims and that the main case, related to the development of an allegedly infringing game, is not ripe for judgment.
The game Light of Motiram, described as an open-world survival title, has drawn attention for its similarities to Horizon Zero Dawn, particularly in its main character, which has led to comparisons between the two. Although the developer and Tencent subsidiary, Polaris Quest, removed references to elements that could evoke Horizon Zero Dawn from its Steam page, this has not been enough to mitigate Sony’s accusations.
The legal battle between both companies is far from over, and a new response from Sony is expected in the coming days, suggesting that this dispute over intellectual property in the video game industry will continue to develop.
