You know that there is a big mess in the United States between the Government and the most relevant app in the world. After the ban signed by Congress against TikTok, the Chinese company has decided to take action by suing the Joe Biden Government. The fight begins.
TikTok has sued the US Government over the new law that would require the short video app to divest from its parent company ByteDance, based in China, or face a ban in the country.
In a lawsuit filed on Tuesday, TikTok claims that Congress “has taken the unprecedented step of singling out and expressly banning TikTok” and describes the measure as “unconstitutional”.
What TikTok argues in favor and against the White House
The lawsuit argues that a sale of ByteDance is not possible and that the law would “force a shutdown” before January 19, 2025.
“For the first time in history, Congress has enacted a law that subjects a single expression platform with its own name to a permanent nationwide ban, and prevents all Americans from participating in a unique online community with over one billion people worldwide,” states the lawsuit.
Last month, President Joe Biden signed a law granting ByteDance nine months to divest from TikTok or cease its operations in the US, citing national security concerns. However, the lawsuit alleges that the government has not yet provided evidence that the Chinese government is misusing TikTok.
TikTok claims that the ban would turn the US version of its app into an “island” that offers Americans a “separate experience” from the rest of its users, while undermining its business.
When the United States tried to ban TikTok during the Trump administration, the company considered splitting its operations in the United States into partnerships with American companies such as Walmart, Microsoft, and Oracle. But those agreements never materialized.
TikTok asks the court to issue a ruling stating that the Biden administration’s law violates the United States Constitution. It also wants an order preventing the attorney general from enforcing the law. Only time will tell what happens, but the battle has begun.
